Instructions on Assessment:

Background information / introduction:

You will be assessed based on advice provided to a client about one of the legal problems outlined below (you will be allocated a problem on a random basis and notified through Blackboard/email of your allocation).

You will need to prepare for a client meeting. This will require you to identify what legal principles apply to the problems, research the relevant area of law, identify what questions you would need to ask the client and what issues would need to be investigated further (for example by checking the contract or lease) and provide an overview of the client's position).

This is an individual piece of work. Whilst we would encourage you to share hints and tips about the technical aspects of creating a flowchart you need to work independently on the content, questions and consequences and these should not be discussed with other students

You are expected to use a variety of credible research materials including books, reports, journals and internet sources to inform your advice. All your research sources and any illustrations MUST be correctly referenced at the end of the report with separate references and if necessary bibliography sections following the Harvard System of Referencing (Cite Them Right) APA 6th edition.

Nature of the submission required - Flowchart and Summary

You must name your file 'Problem' one, two or three

Flowchart 

Your advice should be presented in the form of a flowchart(s).

You will also need to include a reference list, which includes all the sources used in preparing your advice. You will not be required to include in text references on the flowchart. We will provide an exemplar flowchart about another legal problem to help you visualise how your research should be presented.

Summary In addition you should include a short summary of your decision making process in creating the flowchart.

Scenario 

You work in a multi-disciplinary surveying practice. You have just received an email from one of the firm's clients, Alan Jones of Northumbria Developments Limited ("NDL') about some problems that they have encountered on one of their development sites in the North East of England. NDL acquired the freehold title to the site about eighteen months ago. Planning permission has recently been granted for a mixed-use office-led scheme on the site and work has commenced on phase one.

Problems

Problem Three Alan believes that prior to purchasing the site NDL was misled by the vendor who advised them during a conversation on site that the site had only been used for warehousing in the past. Alan recently learnt that part of the land within phase three was formerly used for railway works and that therefore there is a much greater risk of contamination. He has engaged an environmental consultancy, ESL Limited to carry out soil testing. ESL had advised that they would report back within two weeks but that was four weeks ago.
