Instructions on Assessment:
This assessment requires you to advice a client on one of the legal problems outlined below.
You will be assessed based on advice provided to a client about one of the legal problems. It is critical that you identify, apply, and explain the relevant legal principles to provide the appropriate advice.
To do this, you have to research the relevant area of law, identify what questions you would need to ask the client and what issues would need to be investigated further (i.e. by checking the contract or lease) and provide an overview of the client’s position. You must name your file. The name will be based on the problem you are required to answer i.e. ‘Problem one’, ‘Problem two’ or ‘Problem three’.
You must also state the number of words used in the summary.
Flowchart
Your advice should be presented in the form of a flowchart(s). You will also need to include a reference list, which includes all the sources used in preparing your advice. You will not be required to include in text references on the flowchart. We will provide an exemplar flowchart about another legal problem to help you visualise how your research should be presented. Summary In addition you should include a short summary of your decision making process in creating the flowchart. The flowchart, summary and the reference list should be combined in a single pdf document to be submitted to Turnitin. Students should exercise their judgement when allocating the word summary if, for example, there is more than one legal issue that they are required to provide advice on.
Scenario
You work in a multi-disciplinary surveying practice. You have just received an email from one of the firm’s clients, Alan Jones of Northumbria Developments Limited (‘NDL’) about some problems that they have encountered on one of their development sites in the North East of England. NDL acquired the freehold title to the site about two years ago. Planning permission has recently been granted for a mixed-use student accommodation-led scheme on the site.
Problem One-
Alan believes that prior to purchasing the site NDL was misled by the seller, B.P. Mellow, who advised him then that they had not experienced any problems with neighbouring owners. Alan has recently been threatened by a neighbouring landowner, John Smith, with a trespass claim against NDL relating to a long running boundary dispute. It appears that Mr. Smith has complained about this problem in the past to Mr. Mellow.
