Your final assessment should consist of a reflective essay based upon the facts and the law as discussed in the above noted case. In particular, your essay shall cover the following topics
A brief case summary of the facts of the case, the legal issues raised by the case and the conclusions reached by the trial judge as to how she determined the legal issues. A critical examination of the conclusions reached by the trial judge. (I.e. do you agree with the conclusions she reached as to the wrongdoing, fault and liability of the parties? Would you have decided the case differently? If so, why? If not, why? A reflective discussion of the facts of the case as they relate to the concept of risk management. What could each party have done differently to mitigate the legal risks? What could each party have done differently to avoid liability?
