Henry is the security officer of a shopping arcade. During a routine patrol of the shopping arcade, he discovered that the floor of a corridor was wet. Since it was 10 a.m. in the morning and the shopping arcade had just opened, there were only a few shoppers. Knowing that the cleaning staff would wipe and clean the floor every morning, Henry decided to ignore the wet floor and continue his patrol, though it was written on the management company’s work guideline that any irregularities spotted during the patrol should be reported to the security control room at once for follow-up. Unfortunately, an old woman slipped when walking past the shed of water and had a broken arm. The old woman sued the management company of the shopping arcade for causing her injury.
1(a) Discuss whether the case has violated the rules and laws under the criminal law OR civil law.
(b) Identify and explain the type of offence that Henry, the security officer in the case, has committed.
(c) It was Henry, the security officer, who violated the work guideline of the management company but it was the management company that was sued. Please explain the rationale behind this.
